The way I see it the judge didn't make any specific ruling on what the 2002 NDA covered or didn't. He just stated by law using another case as an example that through mergers or acquisitions one doesn't automatically supercede the other. How digecor goes after edigital will be determined by another lawsuit if they pursue. It will be in this possible lawsuit where a judge will determine who meant what and interpret the 2002 NDA. Since edigital did most of the work and is the true innovator and engineer I would think they would be holding the cards in regard to a favorable decision on IP. But then again our courts ruled in favor of O.J. so of course there is some degree of uncertainty. As we all know the stock market doesn't like uncertainty. How certain or uncertain are you?
