It has been my experience that a non-compete is very difficult to have hold up in court for exactly the reason ted striker notes.
However, that won't stop Wencor from being a pain in the arse should they so choose -- and I think we know the answer to that one.
IMO, and it's not worth much in a courtroom, proving large damages will be tough for Wencor since they had already choosen to move production prior to the delayed (and last) shipment of digEplayers. No open POs with EDIG, no way to ship an airline even if EDIG nicked every airline customer from them (they did not) as they had no immediate replacement.
It sure looks like Wencor is either out of the IFE game or on the two year injuried reserve list. And, it would seem like EDIG is showing progress with additional trials -- although trials do not necessarily mean a PO is coming. We've been on the starting blocks more than once, but one of these days a race just might break out.
