TOKYO — Hynix Semiconductor Inc. and Toshiba Corp. Tuesday (Match 20) settled a longstanding patent dispute over DRAM and NAND technology with an agreement on semiconductor cross-licensing and product supply.
Though details were not confirmed, the deal reportedly involves a Hynix cash payment to Toshiba.
The legal wrangling dates back to November 2004, when Toshiba sued Hynix in Federal District Courts in Texas and California after the companies failed to agree on an update of an existing patent-licensing pact. Toshiba also petitioned the International Trade Commission to bar certain Hynix imports. Hynix countersued Toshiba.
The ITC ruled last December that it did not find Hynix had committed patent infringement. Toshiba had said it intended to appeal.
"The signing of the agreements is a positive step for both companies. With the litigation behind us, and through these agreements, we can now strengthen our respective businesses," Shozo Saito, corporate vice president of Toshiba and executive vice president of the company's semiconductor unit, said in a statement.
O.C. Kwon, senior vice president of Hynix, stated, "We believe the agreements will become a good foundation for our two companies to build a mutually beneficial business relationship." |
