This is the line that caught my attention.

"Before agreeing to represent e.Digital in connection with any litigation, Duane Morris reserves the right to review each case on its own merits to make a determination of the merits of the case, and resolve any conflict issues. "

I read this to mean that EDIG & DM have agreed to work together.  If nothing develops...they part company.  Granted, neither party would waste their time if there was not some potential for recovery but to assume more than what is clearly stated is incorrect.
