I have read some of the filings, not all, and from what I have read I have some conclusions: From a commoner, not a legal beagle. I hope that Lawyerlong will or has perused the entire filing and will give us his opinions.

1. BOW has lost the technology battle with EDig so he is now going after the NDA's and the "concept" of the DP being his and cannot be used by EDig. To me that is a sign of defeat. When you have no case you throw sh*t against the wall to see what sticks.  I cannot see where the "concept" of the DP being his that he bought when he acquired APS holds any water at all. If that were the case then Panasonic, IMS, etc... will all owe BOW for their IFE devices. This "concept" he says is his and EDig cannot use it was a common idea, out there for anyone to take so BOW cannot claim ownership of it.

As far as the NDA'a: there are a whole bunch of legal reasons as to why this is a non threat to EDig which I am sure will be discussed throughly. What struck me as be obvious is in reading Boyer's affidavit he states 2 or 3 different times in different ways that the NDA's were to last for xxxx years or UNITL APS AND EDIGITAL CEASE DOING BUSINESS WITH EACHOTHER.

I don't know what the legal meaning of "CEASE DOING BUSINESS WITH EACH OTHER IS" but when BOW attempted to hijack EDig's IP back when and Edig chose not to become a "flunky" of BOW's with an office in the basement in a building in Utah and told him to "take a hike" BOW, in effect "fired EDig" by going with Triad to build a "new an improved DP" (and by the way most likely using EDig's confidential IP acquired by BOW UNDER AN NDA) to build it, then BOW "CEASED DOING BUSINESS WITH EDIG. HE WAS RESPONSIBLE/////////////So if we are to believe what is being stated in more that one place EDig has ceased doing business with APS/BOW and therefore is free to do any business it so choses with IFE or anything else...

Is my thought process valid....if not someone correct me.

There is a whole lot more that is very interesting especially in EDig's counterclaims but that is a lot more legal than I understand but if proven means Edig may own part of BOW's IFE at the very least and BOW appears to be a NUMBER ONE INFRINGER OF EDIG'S IP (MOS)
