Wasn't there conversation or evidence of BOW claiming to have purchased or made an offer to edig in the amount of $25K for the technology inside the digeplayer?

I would think this would be a key element to base an aurgument that APS (Bill Boyer) or BOW could only lay claim to the outer package of the digeplayer.  Never owning the guts.

Again this could have been  previously discussed.
