IP Law and Business is one of the publications I subscribe to.  I have not seen that article yet - it is superb.  Thanks for posting it. Certainly the goal is to avoid a jury trial if possible because of the expense but to convince the other side that you have a strong enough case and the chutzpah to bring the case to a jury.

I actually know a couple of those people in the article and we do business with all those firms. (I had dinner with people from two of the firms mentioned at Brennan's in New Orleans Monday night.)  There are still a handful of IP boutiques but many of them, such as Pennie Edmonds, have been swallowed up by larger firms seeking to obtain their expertise.  Other firms, such as Jenkens and Gilchrist in TX this year, lost so many attorneys to predator firms that they had to dissolve.  All the more reason why these guys strive to be the best of the best.

I was reading a couple of articles in this online magazine recently and Duane Morris showed up in a couple of places.  One company they represent is Lockheed.  Though they are not one of the top IP firms they are very well regarded as  litegator in this area.  Hopefully after the e.Digital litigation they, and we, will be even more highly regarded.

Nice find by you which illustrates why the fact that Duane Morris is working for us on contingency is a big vote of confidence regarding the strength of the e.digital case.
