I'm pretty sure  my statement paraphrasing Putnam preceeded the Duane Morris announcement which was March of this year.  (I've only talked with Putnam about 3 - 4 times since March) At the time I think the context was that Cell phone manufacturers weren't the initial targets as the margins they worked with were relatively small and that they would agressively fight infringement with their substancial resources. At the time Putnam indicated cell phone manufacturers would eventually be targeted. I don't believe I ever quoted him as saying they would be excluded nor intimated such, just that they would not be among the initial defendents and that they would eventually be targeted. This may have changed since that conversation was so long ago.
