From what Silversurfer has posted it is clear that the COMPLAINT was not "SERVED" on 9/19...

Actually, EDIG filed the complaint, then filed some attachements and had the "SUMMONS" issued on 9/19/07, and then they asked the COURT to issue a "SEALED SUMMONS" which was issued on 9/24/07...

Most FEDERAL COURTS are on "FAST TRACK", which mean the Court will allow 30 days to plaintiffs to "SERVE" the complaint and "SUMMONS" on defendants...

Defendants have 30 day from the date the Complains and Summons are "SERVED" on them.

The posting by Silversurfer does not show "RETUN OF SUMMONS" to the Courts file. Therefore, we do not know what was the date vivtar was "SERVED" with the Complaint and Summons...
