And hopefully so will a jury. Those cases easily understood and less technical have the best chance for success.

Jury awards TruePosition $45.3M in patent infringement trial

Philadelphia – A jury in the United States District Court in the District of Delaware in Wilmington has awarded $45.3 million to wireless technology company TruePosition, Inc., finding Andrew Corporation willfully infringed TruePosition’s intellectual property regarding cell phone location technology. On Sept. 14, the jury deliberated for fewer than four hours after a two-week trial and found that the infringement was willful, which may allow for damages to be trebled. The case is TruePosition, Inc. v. Andrew Corporation (Civ. No. 05-747-SLR).

TruePosition had filed a suit charging Andrew with infringing its patent which helps determine the position of mobile devices. The patent dealt with the location of wireless phones using the wireless network control channel, known as the “144" or "control channel" patent, which is particularly important for safety and security applications. This suit focused primarily on infringement related to contracts that Andrew entered into with a customer in Saudi Arabia.

“The jury listened to our facts, understood our position, and swiftly determined that Andrew had deliberately infringed this patent,” said Paul Milcetic, the lead trial lawyer for TruePosition and a partner with Woodcock Washburn LLP. Kathy Milsark, Dan Goettle, Amanda Kessel, and Dale Heist of Woodcock Washburn were also on the trial team. In addition, TruePosition’s 144 patent was obtained by Michael Stein, another partner with Woodcock Washburn.

In February 2004, Woodcock Washburn obtained a $35-million settlement for TruePosition as well as warrants entitling TruePosition to purchase one million shares of Andrew's common stock at a price of $17.70 per share for a period of four years along with licenses to certain Andrew intellectual property.
