How much weight does "precedent" carry in this type of action. It would seem that we need a favorable decision up front in order to carry on with subsequent cases. Maybe Vivitar was chosen because it was perceived as a "slam dunk". That would put precedent on our side. Of course, if it never goes to trial.......
