It is my understanding backed by a ruling from a Federal judge that the IP question relates only to the Digeplayer. The eVu has already been ruled by that Federal judge to be a new, different product, not connected to the Digeplayer.
That says to me as well as EDigigal that going forward with business based on the eVu is legally OK and not in question. It has different IP that the Digeplayer.
I may be wrong about that but I don't think I have misread any of the posted legal proceeding here on Agora. Now if EDig did any business with airlines using the Digeplayer IP before using the eVu that could mean something different if BOW prevails. However, I don't remember any business done with the Digeplayer by EDig after its split with BOW.
If you remember the last shareholders meeting the split with Wencor was extensively discussed and the reason for the split was Wencor's insistance on having EDig's IP to proceed with its development of the Digeplayer and EDig being adament saying "NO", "HELL NO" to that demand. EDig has all along stated the MOS was their IP and never sold to APS.
iT was Wencor that initiated the split NOT EDIG. It speaks volumes of what BOW thought and legally knew at that time about who owned that technology.
