Even though I tend to agree with you, I have never seen anything to suggest that Wencor is backing off the suit, in fact they continue to press the issue indicating their belief in winning.

As LL would say, one does not know what the courts will decide, and neither do we, so it is not a given in my opinion.

My concern continues to be based on a what if situation. What happens to our DM lawsuits if Wencor wins the lawsuit? Is there a direct or indirect relationship between the lawsuits as to the patents and the technology being used?

No one else seems concerned about this possibility, but all variables must be considered. I hope DM would have investigated this matter in depth and determined in their minds that our case was very strong and the probability of winning was almost 100%.
