It would be a mild surprise if it did occur... I can think of one reason.

I'm sure others may be able to think about how it could happen when you consider what has been posted on the board over the past 6 weeks or so... look at the timeline of answers, markman date and filings.

I can see the possibility of a settlement with Vivitar, sooner rather than later.
