The total process does not seem so long if you consider what Sman has posted in not rushing a Markman and being in the best interest of the plaintiff. It is, in essence, I guess, a trial by judge.

In other words allow the judge to absorb as much as possible before forming an opinion.

It makes sense, as long as the jury trial date is set very shortly there after, in this case it seems it is.

As the discoveries are made and entered, the defendants are going to know where they stand and what points made a judge will favor.

The way I was reading things I thought we might be looking at over 4-5 year process just for Vivitar.....lol
