The question is, can DM extract a few million dollars from the buyer of Vivitar, considering they are already willing to assume $60 million of debt.....will they look at legal fees being more than a simple one time settlement and licensing agreement?

I would guess yes and venture to say DM would prefer a clean, undisclosed settlement in round one.

We don't want to kill the deal of the sale of Vivitar but rather win a quick settlement and move forward. Dealing with the new buyer of Vivitar will be much less emotional and much more practical of a deal, imo, than dealing with Vivitar-Syntax after they just paid $26 million two years prior.

No doubt, a very interesting turn of events with Vivitar out from under the chapter 11 proceedings and still accessible to DM.
