You are correct.No one has to do anything except to pay attorney's.Anyway it is thier choice to wait and pay a fee that could be much more that if they choose to settle and pay a MUCH lower price.IMO if I knew I was in the wrong then I would choose to pay the lesser amount and get it behind me.
