I would caution investors not to be expecting a settlement announcement with Vivitar at next week’s shareholders meeting. It could certainly happen but I wouldn’t expect it. From Vivitar Doc 32, both parties are required to inform the Court by 1 Oct 2008 of any such settlement agreements so there would be a filing on PACER.

1. Disclosures. Except as provided by paragraph 1(h), and, to the extent not already disclosed, by October 1, 2008, each party shall disclose to every other party the following information:

(f) any settlement agreements relevant to the subject matter of this action;

Just checked PACER and no new filings on any case. Will check again later as they occasionally upload them late for some reason.
