Does the case automatically go away with the takeover of the name?

IMO, it's important that we get to the Markman, go through the process and hear what a Judge has to say about it. Recovery or not!!

IMO, a Judges opinion sort, is not totally about audio.

e.Digital does not have to prove audio from their stand point ....they just have to prove infringement on that account, that is why audio is emphasized.
