That's an interesting article, however I still don't think it HAS to be an either/or situation. Everything is negotiable and DM isn't in this game to make nicey-nice without making any money for themselves. Remember DM is calling the shots - with input from EDIG of course and consideration for each situation, but still calling the shots.

On the other hand if the agreement is confidential, it could be that no money changed hands if it somehow strengthened EDIG/DM's position with the next infringer (that we had reached a settlement already). I guess who knows, eh?
