I don't think it matters who the first infringer is. In light of predicitons that nothing should be expected until 2010, this was a big deal for investors and the market agreed.

This stock moves on NEWS and this was a very significant piece of news....the result of a decade's evolution of a growing multi-Billion consumer electronics market of which EDIG owns a significant piece.

This is news of a new source of revenue for the company, a validation of the patent portfolio that has over 180 licensing agreements yet to negotiate....AND it is very important to note that many of these will come sooner rather than later.
