11. Claims Being Asserted Plaintiff plans to assert 18 claims of the Patents-in-Suit in their infringement contentions due November 21, 2008. Defendants assert that, consistent with the Court’s Example Docket Control Order, the Plaintiff should limit the number of asserted claims to no more than ten (10), no later than March 13, 2009.
12. Possibility of Early Mediation The parties are not opposed to attempting to resolve their dispute through mediation and intend to discuss mediation at an appropriate time. The parties will attempt to agree upon a mediator. If the parties cannot agree on a mediator, the parties will submit the name and address of two proposed mediators to the Court, and shall agree to mediate their dispute before a Court appointed mediator.
