Where would the "opinion" on technical likeness be determined? Is that a Markman decision or does it come in a trial?

I can see the patent 774 use in many devices (voice recorders w/removable flash come to mind).

I would guess (guess only) that DM sees the technical (or legal) link but I would love to see it.
