I certainly agree that we don't have a lot of information, but I will make my WAG.
LG represented "a bird in the hand" vs. one in the bush. Using LL's comment about "why settle with LG?," it is possible (WAG) DM wanted to put some dollars in their pile. I realize many want to see far more than the ~1.6M (of course). I must state that this is in no way chump change to any reasonable person or any $4M gross company with constant red ink. It simply did not meet some expectations.
In guitar language and for everyone:
$1.6 mil does not suck!
If they must have a Markman win and they have 20+ low hangers, then they only need to get a Markman win against what they believe is their best chance to win. All others can settle and put millions in the bank.
If RP's statements are true, we'll see it in 2009. That was the time many here have speculated. It makes sense should all pan out, but we don't KNOW dick about a time line to black ink and, as stated in multiple posts, I believe that will be the first step to a mulligan at Torre Pines.
