When I said this "Settlement" thingy with digEcor was a "THING IN PROGRESS" and the parties were engaged in some "House Cleaning" that is what I meant. I am glad you posted the RULES governing mediation...
Remembering that this is NOT a mediation with a "Rent Judge" and actually one of the UTAH Court's judges is "Running it", it is significant that it was followed by the "dismissals", which you can bet were agreements reached before the Judge during Thursday's Mediation session to do the needed "House cleaning" before the settlement between the parties are reduced into the "Written document" which represents what they have agreed to...
Procedurally, EDIG did not have to agree to dismiss anything, if indeed the Thursday session was a flop and this case was going to trial. Certainly, the Court could ORDER such dismissals after a Mediation session. However, there is no indication that such ORDER was issued...
Which makes your conclusion that this is a prelude to filing of "the Settlement" quite an astute observation by you...
