If so, there is no mandatory requirement that all "settlements" happen only with those who are named as defendants in a Court action...

So, concurrent with the Court actions theere may and can be settlement discussions going on with other potential "Infringers" who are participating in discussions with EDIG about its claims of infringment, and there may be some settlements popping up in that arena...

IMO this may turn out to more productive avenue of pursuing settlements by DM after they get their MARKMAN RULING...
