It behooves these companies in "trouble" to settle early rather than risk huge jury decisions against them, especially in these times.

In the old days when they were cocky, looking at exponential growth and loaded with cash their strategies were to drag things out forever...but these are different times and managing their liabilities by minimizing exposure will be their focus.

Expect more rapid settlements as we have seen so far. Mounting legal fees larger than the settlement fee is not prudent.
