One of the things that seems to be left out in all the discussions about the amount of settlements seems to be "WHAT WAS THE INFRINGING THAT DEFENDANTS HAD DONE?"...

In short, a defendant does not pay EDIG because they are a BIG name as opposed to a nobody in the Tech. industry. They pay for what the plaintiff can convince them the value of the case is less any breaks they get if they do not litigate it...

We settled for $1.6 million with L.G. because of many reasons, one of which was that the settlement was the first and they got the break. We do not know what the other reasons were...

Each case shall be evaluated by DM on its own merits and then they have to sell it to defendants...

So far, they seem to be doing great. 6out of 8 in 10 months...
