If not, it seems like DM would be in a good position to wave off any low-ball settlement offers coming from Samsung - saying: "Nah, not enough - we'll take our case to the Markman hearing... unless you're willing to settle for say - $50 Million?"

If I were DM and preparing to file a new round, I'd keep Samsung on the hook unless they popped for the big bucks.
