I can see them showing the 40% due DM as a cost of Sales if desired, however I would think they would show any other legal expense as a "Other Expense". Additionally we cannot determine legal expenses incurred for the Utah situation vs the DM patent expense until the BOW event is concluded.

By the way, in your summary the taxes would apply only to edig and I believe you subtract out tax from the total, then make the distribution.

As best we can tell the $1.6 and $3.65 was the gross amount and the Cost of Patent Expense was due to DM. The one problem is that the numbers do not compute accurately for last quarter.

I still cannot figure out why they try to hide some of the detail, the 10Q and 10K shows some but not all and it does n o harm to list the expenses appropriately.
