A while back some one posted here that the brand VIVITAR was still selling a host of products in the market...

Thus, the New Jersy company that bought the VIVITAR BRAND to do all the selling, can still be held liable in the DM action, unless they are also filing for Bankruptcy...

In short, if the barnd is still active under another name there can be a "piercing of the Vale," and DM can follow thrugh with his law suit showing that the VIVITAR bankruptcy, and its sale to others, was a fraudulant ploy to avoid liability for patent infringments, and FRAUD is a basis of negating the STAY ORDER issued by bankruptcy Courts authomatically when Bankruptcy is filed....

At this juncture the question for DM is, is it worth their while to follow up on that claim?...
