Certainly, being human and understanding that hindsight is always 20/20, e.Digital's attorney(s) that reviewed the NDA initially let this one slip to some degree. Why take a stance of "sue me" rather than push back a little harder on the initial language. Boyer wasn't in the greatest of bargaining positions...he had an idea that wasn't entirely unique. Anyway, people make mistakes, and this has been an unfortunate chapter (not death penalty) for e.Digital. I'm very happy to have this issue closer to resolution and look forward to watching the company progress.
