That is what I said in my post. DM can't raise the same claims of infringment made in this law suit in the future. But, since Samsung agreed to drop their claims of non- infringement (see, part 2 of my post) also WITH PREJUDICE, and also agreed to drop their claims of INVALIDITY of the 445 and 108, thus we have couple of VALID patents in 445. 108 which can sustain additional calaims of infringement against SAMSUNG in a separate law suit in the future, at which point they can raise the defenda of INVALIDITY as the dismissal here was WITHOUT PREJUDICE...
