"The markman is merely a claims construction hearing, but in IP litigation it can be the central issue and is often dispositive of the case. The "winning" party can file a motion for summary judgment for the entire case following a markman hearing and it is often granted."

The trial, as far as I understand, is not branded a Markman...it's trial by jury branded with the case properties.
