"The legal expense alone "has been significant" and that "has been a major issue for both sides", he says. "We've tried settling this multiple times to avoid getting into this expense."
Additionally, says Heckel, the case has "been a distraction, as [DigEcor] has had to dedicate resources to it" such as staff.
The company remains productive, and is eyeing further expansion. But Heckle believes that, "had this [case] not been an issue that we had to deal with, we would have been even more successful."

Btw, WHO SUED WHOM ? I guess now, in light of the courts favorable findings for e.Digital, it doesn't look like such a good idea.
EDIG should be smart and have this case put behind them prior to announcing earnings or revealing the round 2 list....sailing with clear skies takes you further, faster.
I think digecor's strategy was to bankrupt EDIG...I guess they didn't factor on EDIG having a breakout year while the courts would sink digecor's ship.
Might we see some consolidation here?
