You're correct they could have begun the suits 10 years ago..."if" they had the money at the time to do so. Since they didn't have the cash to do it themselves, there had to be enough "value" to attract a legal team who would take it on contingency. I would submit that the pursuit of such a team occurred long before we ever heard about it.
