yes, I understand what you're saying, however, the statement seems to be with regard to their own patent application efforts.

The DRM agreement has nothing to do with their patent applications...that was a business deal gone bad where for the most part has been sorted out.

From what I read, the original license issued to Boyer has gone sour and was not renewed by Wencor, where they are now claiming that the DRM agreement should take president over the original license. e.Digital has made it clear that the original license was in place prior to any DRM agreement and has nothing to do whith the DRM agreement.
