I wonder how much Samsung has already spent in legal fees to defend themselves from that little patent troll e.Digital. Don’t they realize that they could simply settle for a mere 1.68 million?? Or perhaps that is not the case at all.
We keep waiting for DM to take this to the next level. I believe they may already be doing that as we speak. Taking Samsung through Markman is the only way to ensure larger and more numerous settlements going forward (assuming we win of course). I think more filings are still coming but I wonder if they are waiting purposefully in order to keep future companies from attaching themselves to the Samsung case. There must be some rule or precedent that restricts this tactic if the existing case has been going for a certain length of time, has passed some milestone, or is nearing Markman. I certainly don’t know but if I were DM, I would want Samsung all alone at Markman and I would also want to leverage a favorable decision (or the threat of a favorable decision) against as many more companies as I could.
We are now less than 8 months away from Markman. In less than 2 months, we’ll have the first quarter report (from which I expect virtually nothing) and hopefully the digEcor decision behind us. I’m guessing that we’ll see more filings shortly after that... sometime in September I’ll say.
I agree it would be helpful if eVU business were to pick up but it’s difficult to judge the chances of that happening given the current economic climate. I prefer to see that as a nice surprise if it happens. So yes it’ll probably be pretty quiet news-wise for awhile yet... nothing new there. However with about 3 million in the bank and very little debt remaining (about $400K to be paid off with stock), it appears that the company can last at least another year without any financing. That’s actually nice for a change and a good position to be in while we wait for the next significant event.
