Remember the first filing ? VIVATAR < Woulnd't you think sence it was 6 months before the 7 co filing that initially it was the Markman canidate .

They filed BK and DM had to change the plan ! , IMO samsung was never the Markman choice , Which is also why the next round got delayed when sammy held out so long .
