If DM is to stay on, his contingency fee may be affected by the fact that SAMSUNG may choose not to sue all of the 174 identified infringers...

What then? Does DM get anything for those not sued because of SAMSUNG choice?...

What about those potential "CUSTOMERS" of SAMSUNG that may be a part of the 174 and Samsung gets them to make deals with Samsung in other AREAS using EDIG patenet infringment claims, and takes them off the list?...

Or would DM agree to stay on Hourly Fee basis?...

In short how the Settlement Agreement with EDIG affects potential FEE of DM under his agreement presents complicated questions of making an assessment of the potential fee for DM so as they can buy it out for 15%, or retain DM's services for comprable compensation.

That is why they need the addition time, to work out the ANSWER to all these questions...
