EDIG would most likely win an appeal easily - only it would cost more money.

If digEcor did appeal and lost again, I wonder if EDIG could ask for reimbursement of attorneys' fees spent during the appeal. From the recent 8-K, they are considering the possibility of recovering costs from the lawsuit.
