I also believe the timing is such that shareholders will be nicely surprised in November. Since they finalized the Samsung settlement in Sep 09 and the ASM was announced in Oct 09, there is no doubt in my mind they wanted the ASM held after the Samsung amount is publicly released in the 10Q. If the amount was terrible, one would think the timing might be different. I also think about how near we were getting to a Markman...that had to influence Samsung's decision to settle. Given that the other 6 infringers settled quickly with no substantive fight tells me we also had Samsung between a rock and a hard place.

Not sure if new infringers will be named before the ASM but that would be real icing on the cake. Their last PR talks about the next licensing and legal round in upcoming communications. What better time than before or during the ASM when about to face shareholders? With DM's 100% patent monetization win record, filing a new lawsuit with 15-20 defendants would definitely attract new investors.
