At least 7 defendants have NOT been served. They are the foreign parent companies of various defendants (i.e., Canon Inc, Panasonic Corp, HTC Corp, Leica Camera AG, D&M Holdings Inc, Kyocera Corp, DXG Technology Inc). DM is trying to reach a settlement with these companies in order to not have to deal with something called the Hague Convention.

• The Hague Convention on Foreign Judgments in Civil and Commercial Matters is a multilateral treaty governing the enforcement of judgments entered by one nation's legal authorities as enforceable by the authorities in other signatory nations. It is one of a number of conventions in the area of Private International Law signed by the members of the Hague Conference on Private International Law in 1971.

The judge gave them until 29 Jan 2010 to reach a settlement otherwise they will have to serve these foreign companies.
