"Rand: If you don’t protect business processes, you don’t get a lot of investment in them. It takes less than 1/10 of the cost to steal rather than to develop. Unless you can exercise an extreme first mover advantage, why bother? Betamax was 10 times the technology VHS was, but VHS pushed them out real fast."

Thing is, e.Digital has patents of their considerations, and they are not business processes.

Their patents have gone the process of combined USPTO and PCT / ISA.... into chapter 2 demand, however, there does not seem to be any further info regarding chapter 2 action taken.

The details of protecting rights sure are miserable, the commentary in that Q&A is telling.

The only thing that small companies can do is apply and hope for the best....So far DM has come their way.....and they pretty much have the fire started.

IMO, not many companies are going to get that type of consideration unless the story is compelling.
