I've wondered this too. The EDIG/DM agreement says DM will get 40% of the total recovery. An annual royalty amount wouldn't be known until all sales for the year are determined. Since the Wolverine deal includes an annual royalty payment, I believe DM will get 40% of it, along with 40% of the one-time license fee. That's what their agreement says.

Contingent Fee in the Event of Litigation: In the event that a party refuses or is not asked to license the Norris Patents or any element thereof, and litigation is filed, Duane Morris shall be entitled to the following contingent fees of the total recovery (“Total Contingency Amount”) in each individual case upon the Resolution of the matter:
Upon filing of complaint or counterclaim in declatory judgment action 40%
