So, WATCH THE PACER is the word for the next couple of months...

As I read RP and company's statements, there is indication that "the elements" they refer to somehow are related to conclusion of TIER I, and the start of TIER II efforts by DM. And IMO if some of the GROUP of 19 choose "not to settle" they will be processed though the "Discovery Phase" for trial while the TIER II filings are made at the same time...
