It's not a matter of the defendant or the plaintiff needing it.....it's part of the process. The reason is to streamline the process.

Now that it is part of the process.....that alone makes defendants act swiftly.

IMO, we do not need it, but it sure helps in moving things along to settlements.

Defendants will decide for themselves the validity of a set of patent claims.

Perhaps one will challenge to a court consideration, if so, DM is ready for it.

I feel we were all put on the wrong track of understanding way at the beginning with regard to Markman hearing.
