They're going to try and convenience the court that the methods are not novel....and are in effect a standard consideration within the industry.

I think they are going to have a tough time pointing to a formalized set of standards streaming data directly off a non volatile. I also feel they are going to have a tough time downplaying the micro-controller to ROM code interface sequences.
