Very possibly the case, but it would seem there are many lower level infringers that would not requre a Markman win in order to extract settlement dollars, as was the case with some of the first 10 settlements.

I guess we stay focused on "THIS CALENDAR YEAR" and remain patient in the meanwhile. I should be buying more right here but with Obama lurking who knows what next year brings.
