This second PACER you posted clarifies the ORDER by Judge MARCIA who will be conducting the Markman Haring ORDERING everyone to appear before her by July 30, 2010...

It is a squeeze play by defendants who are playing games regarding the proposals made by DM regarding discovery and which claims EDIG will be asserting at the Hearing.

The discussions are on going and now we have a deadline by the Judge, who will be conducting the actual Hearing, for the parties to get their act together.

So in reponse to questions by 98 observer I beleive settlements are still in the works as defendant counsel, according to DM, have sent the list of questions posed by EDIG attorneys to their clients and a response should be forthcoming by the date set for appearance befor Juge Marcia S. Kreiger by 7/30/2010. As they ponder the EDIG set of questions and know they have to provide ANSWERS by the time of setting before Judge Kreiger they will decidedly be pondering if they should settle and be done with it.
